2. Personal data
Personal data is information about the personal or material circumstances of an identified or identifiable natural person. Statistical data that we collect, for example, when you visit our website and that cannot be directly linked to you personally is not included.
Personal data is any information relating to an identified or identifiable natural person. This includes, for example, information such as your name, your age, your address, your telephone number, your date of birth, your email address or your IP address. Information from which we cannot establish a link to you (or only with disproportionate effort), e.g. through anonymisation, is not personal data. The processing of personal data (e.g. collecting, querying, using, storing or transmitting) always requires a legal basis or your consent.
We collect, store and process your data for the entire duration of the legal relationship with you or your enquiry, including any subsequent warranty claims, for our services and in accordance with the statutory retention periods (in particular under tax law). Newsletters and electronic advertising are sent until revoked.
Your data is not passed on to third parties unless profuturum is entitled or obliged to do so for legal reasons or you have given your consent in this Privacy Policy. The exception to this is the necessary disclosure of data by profuturum to service providers commissioned with the organisational or technical processing of the order or the performance of goods deliveries, such as banks, postal or parcel services, insofar as this is necessary for the delivery of the goods. Data passed on in this way may be used by our service providers solely to perform their task. Any other use of the information is not permitted and does not take place with any of the service providers we engage.
3. Data processing
Below we inform you which personal data we process when you use our products and services at www.profuturum.net. We also explain for what purpose we use this data and on what legal basis.
3.1. Provision and use of the website www.profuturum.net
We collect and use personal data of our users in principle only to the extent necessary to provide a functioning website and our content and services.
When you visit and use our website, we collect the personal data that your browser automatically transmits to our server. This information is stored temporarily in a so-called log file.
The following information is recorded without any action on your part and stored until automatic deletion:
- IP address of the requesting computer;
- date and time of access;
- name and URL of the file accessed;
- website from which access takes place (referrer URL);
- the browser used and, where applicable, the operating system of your computer and the name of your access provider.
We process the data mentioned for the following purposes:
- ensuring a smooth connection to the website;
- ensuring secure and convenient use of our website;
- fulfilling our contractual obligations to you;
The legal basis for the data processing described in 3.1 is Art. 6(1)(f) GDPR. Processing the data mentioned is necessary to provide a website and to enable secure and convenient use, and thus serves to safeguard a legitimate interest of our company. In addition, there are no overriding interests of the website user, so the interest of the website operator prevails.
3.2. The collection of data for the provision of the website and the storage of the data are absolutely necessary for the operation of the website. Consequently, the user has no right to object. Further storage will take place in individual cases where this is permitted or required by law. Data storage is permitted where there is a legitimate interest, for example to ensure IT security, to detect and prevent abuse and to carry out security audits.
3.3. Registration in the portal / creation of a user account
On our website we offer you the option to register by providing personal data. We use the processed data to create an individual user account for you, with which you can use certain content on our website. We process your email address so that we can send you new access data should you ever forget it.
The following overview shows in detail which personal data we process from you on registration:
- Name
- Email address
- IP address
- Telephone number
- Personal password
The processing of the personal data described is based, in accordance with Art. 6(1)(a) GDPR, on the declaration of consent that you voluntarily gave on registration. The declaration of consent is given unambiguously and in an informed manner, relates to the specific processing and has not yet been revoked. Consent can be revoked at any time with effect for the future using the contact option above.
As a user you can delete your registration or user account at any time. You can also have the data stored about you amended at any time. Early deletion of the data is only possible where this does not conflict with contractual or statutory obligations. If the processed data is required to perform a contract or to carry out pre-contractual measures, deletion is not possible until the purpose has been achieved. Further storage will take place in individual cases where this is permitted or required by law. Data storage is permitted where there is a legitimate interest, for example to ensure IT security, to detect and prevent abuse and to carry out security audits.
3.4. Performance of a contract / project licence
On our website we offer users the option to conclude a contract with profuturum for a project licence by providing personal data. The data required for this is entered into an input form and transmitted to us and stored. Personal data is not passed on to third parties unless otherwise provided for herein or you agree to the transfer. The following data is collected when a project licence is concluded:
- Billing address
- Payment information (bank, IBAN, BIC, etc.)
- VAT ID
The provision of the above personal data is necessary to perform the contract concluded with you. If you do not provide us with this data, we would not be able to conclude or properly perform the contract.
To process payments, we pass your payment data on to the credit institution commissioned with the payment. These companies may only use your data to process the order and not for any other purposes. If you conclude a contract on our website and provide your email address in doing so, we may use it to send a newsletter relating to our own similar goods or services.
The legal basis for the processing of your personal data described in 3.3 that is necessary to perform a purchase contract concluded with us is Art. 6(1)(b) GDPR. This also applies to processing operations necessary to carry out pre-contractual measures.
Upon complete performance of the contract and full payment, your data will be blocked for further use and deleted after the tax and commercial law retention periods have expired, unless you have expressly consented to the further use of your data. Further storage may take place in individual cases where this is required by law.
4. Newsletter
You have the option to subscribe to an email newsletter on our website. All you need to do is enter your email address in the field provided. If you contact us via the form on the website or by email, the data you provide is stored by us for the purpose of processing the enquiry and in case of follow-up questions. We never pass this data on without your consent. Once you have subscribed to the newsletter, we send you a confirmation email with a link to confirm the subscription. Confirmation of the subscription is not required for users who are already registered and who have given their consent to the processing of the personal data described in accordance with Art. 6(1)(a) GDPR in the declaration of consent they voluntarily gave on registration (see point 3.2). In this case, the storage and processing of your email address serves exclusively to send you the newsletter you requested. The content of the newsletter serves advertising purposes. In particular, our products and services are advertised in our newsletter. You can unsubscribe from the newsletter at any time by clicking the “Unsubscribe from newsletter” link in a newsletter.
5. Disclosure of data to third parties
We only pass on your personal data to third parties if:
- you have given your express consent pursuant to Art. 6(1)(1)(a) GDPR,
- this is legally permissible and necessary under Art. 6(1)(1)(b) GDPR to perform a contractual relationship with you,
- there is a legal obligation to pass it on pursuant to Art. 6(1)(1)(c) GDPR,
- the disclosure is necessary under Art. 6(1)(1)(f) GDPR to safeguard legitimate business interests and to assert, exercise or defend legal claims (including disclosure to debt collection agencies and credit reference agencies) and there is no reason to assume that you have an overriding interest worthy of protection in your data not being disclosed.
Where we commission third parties to process data on the basis of a so-called “data processing agreement”, this is done on the basis of Art. 28 GDPR.
6. Server log data
When you visit our website, log data that does not allow us to draw conclusions about you personally is automatically recorded and stored temporarily. This data includes, for example, browser type and version, referrer URL, truncated IP address, provider name and operating system used. All log data is evaluated in anonymised form by us or by the service provider we commission, exclusively for statistical purposes, to improve our offering, to make troubleshooting easier and to defend against attacks on our website.
7. Cookies
To make our website user-friendly (web analytics) and to enable the use of certain functions, we use cookies on our website.
Cookies are small files that are stored locally on your data carrier and that store certain settings and data for exchange with our system via your browser.
Most of the cookies we use are session cookies and are deleted from your hard drive again when you close the browser. The long-term cookies we use remain stored on your hard drive for a maximum of 30 days and are then deleted. On a further visit, this means it is automatically recognised that you have already been to our site and which entries and settings you prefer.
By using our website, you declare that you expressly wish to use our web service and, insofar as cookies are accepted according to your browser settings, that you agree to the use of these cookies. Most browsers are set by default to accept all cookies. However, you can set your browser so that cookies are displayed before they are stored, only certain cookies are accepted or rejected, or cookies are rejected or deleted in general.
Please note that changes to settings always affect only the respective browser. If you use different browsers or change your device, the settings must be made again. In addition, you can delete cookies from your storage medium at any time. For information on cookie settings, changing them and deleting cookies, please refer to the help function of your web browser.
The legal basis for the processing of personal data using cookies is Art. 6(1)(f) GDPR. If you have given us your consent to the use of cookies on the basis of a notice we provided on the website (“cookie banner”), the lawfulness of their use is additionally governed by Art. 6(1)(1)(a) GDPR.
8. Tracking and analysis tools
We use tracking and analysis tools to ensure the continuous optimisation and needs-based design of our website. Tracking measures also enable us to record statistically how visitors use our website and to develop our online offering further for you on the basis of the findings gained. Because of these interests, the use of the tracking and analysis tools described below is justified pursuant to Art. 6(1)(1)(f) GDPR. If you have given us your consent to the use of cookies on the basis of a notice we provided on the website (“cookie banner”), the lawfulness of their use is additionally governed by Art. 6(1)(1)(a) GDPR. The description of the tracking and analysis tools below also sets out the respective processing purposes and the data processed.
8.1. Hyperlinks
Our website contains so-called hyperlinks to websites of other providers. When you activate these hyperlinks, you are redirected from our website directly to the website of the other provider. You can recognise this, among other things, by the change in the URL displayed in your browser. We cannot accept responsibility for the confidential handling of your data on these third-party websites, as we have no influence on whether these companies comply with data protection regulations. For information on how these companies handle your personal data, please refer directly to these websites.
9. Data subject rights
The GDPR gives you the following rights as a data subject of the processing of personal data:

Under Art. 16 GDPR you can request without undue delay the rectification of inaccurate personal data or the completion of your personal data stored by us.
Under Art. 17 GDPR you can request the erasure of your personal data stored by us, unless processing is necessary for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.
Under Art. 18 GDPR you can request the restriction of the processing of your personal data where you contest the accuracy of the data, the processing is unlawful, we no longer need the data and you oppose its erasure because you need it for the establishment, exercise or defence of legal claims. The right under Art. 18 GDPR also applies to you if you have objected to the processing pursuant to Art. 21 GDPR.
Under Art. 20 GDPR you can request to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format, or you can request its transmission to another controller.
Under Art. 7(3) GDPR you can withdraw your consent, once given, at any time by notifying us at the email address given above. As a consequence, we may no longer continue the data processing based on this consent in future.
Under Art. 77 GDPR you have the right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence, your place of work or our registered office for this purpose.
10. Right to object
Where your personal data is processed on the basis of legitimate interests pursuant to Art. 6(1)(1)(f) GDPR, you have the right under Art. 21 GDPR to object to the processing of your personal data, insofar as there are grounds relating to your particular situation or the objection is directed against direct marketing. In the case of direct marketing, you have a general right to object, which we will implement without you having to state a particular situation.
11. Data security
The security of your data is very important to us. All personal data we request is transmitted encrypted over a secure SSL connection so that it is protected from third-party access. In addition, we take further technical and organisational security precautions to prevent the loss, destruction and misuse of data. You should always treat your access information confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others. The personal data and information you provide are protected with the greatest possible care against unauthorised access by third parties. Within the bounds of what is reasonable, we will take all measures to ensure the security of personal data. However, the customer is advised that the World Wide Web is accessible worldwide and that misuse in particular cannot be ruled out, so that even with the greatest possible care, unauthorised access by third parties to such data and information cannot be excluded.
